It’s over. Both exams looked tough this time around. We had DC (via the NCBE) throw a crazy crossover question on the essay portion and Virginia go absolutely nuts and test nearly every subject possible on the essays (17 subjects tested on essays). Additionally, the MBE was not an “easier” MBE as the past 2 July ones have been.
Starting with DC, predictions were fairly accurate but we had a first ever contracts/comm paper crossover question along with the unpredicted family law and civ pro. Quite surprised to see they skipped criminal this time around, making only two MBE subject questions. Hopefully this is not a new trend as criminal law is a cornerstone for any newly licensed attorney to be familiar with.
As for Virginia, they went nuts on the essay subjects testing as follows:
1) Wills/VA Civ Pro
2) Va Civ Pro/Fed Civ Pro/Conflicts
3) Sales
4) Personal Property/VA Civ Pro
5) Crim Law/Crim Pro
6) Corporations/Partnership/Tax (Yes, Tax!)
7) Secured Transactions
8) Local Govt Law/Equity
9) Suretyship/Creditors’ Rights/Agency
Those Virginia questions were definitely challenging as they hit the obscure subjects that are not normally tested. I mean, Sec Trans + Surety + Cred Rights + Tax on one exam? They were looking to punish the test takers this Summer, that’s for sure.
Anyway, good luck to everyone and I sincerely hope you all pass. The waiting is the hardest part. (Yes, Tom Petty knows what he’s talking about) How about some predictions on when the results will be released? I say 2nd week in October for Virginia and last week in October for the DC Bar Exam.
I’ll be back when the February 2011 preparations begin…

The Wills question included a component of VA Civ Pro as well, in that it asked what court would be the most appropriate for probating the Will. In order to answer it, you had to know the presumption that going to a nursing home does not rise to the level of changing a domicile from one city in VA to another. From what I heard, a lot of people did not know that.

Good point. Barbri mentions the nursing home rule in its Wills lecture, which makes sense, but domicile at death is definitely a VA Civ Pro issue. I’ve updated the question list. Additionally, the POD question/issue could have fallen under contracts.
I wish you were right about 2nd week of October. The 20th, though only a week and a day, seems to far away. I’ve had my TN results since last Friday and am looking forward to being a VA lawyer (as are my employers LOL). By the way, thanks for acknowledging my last post. I’ve never actually had an impact on a blog before. Made my day (sad, but true).
